This is an agreement between Zygg Mobility Inc (hereinafter Zygg) and (the Renter) for the rental of one or more electric bikes, for a fixed period of time (the Term), upon completion of which and in good standing, ownership of the ebike will then be transferred to the Renter.

I Understand that

1. The e-bike(s) are owned by Zygg and/or its finance partners. They remain AT ALL TIMES the property of Zygg and/or its finance partners until

a. all rental payments have been made on the original due date, or approval in writing from Zygg to a new rental schedule,

b. A sales receipt is issued noting the make, model and serial number 2. The e-bike is not the Property of the Renter, and may not be resold, transfered, rented or loaned with prior permission in writing from Zygg.

3. The e-bike was serviced and safe to ride when delivered by Zygg. After this time, it is up to the Renter to ensure that the e-bike is safe to ride.

a. All service and maintenance is the responsibility of the Renter

b. The e-bike will come with a full manufacturer warranty (if new), or may still have some manufacturers warranty (if Used eg above 250 km at the start of the rental).

c. If the e-bike is marked as Used or Refurbished, it may also have a Zygg guarantee on service, or battery life which will be detailed separately from this agreement d. Any service provided by Zygg will be at standard Zygg Shop rates.

4. Rental Payments are due every month on the same day, and collected automatically on the credit card provided. Failure to make a rental payment when collected (ie a credit card payment ‘bounce’) will trigger the following Missed Payment protocol:

a. If the payment is made within 24 hours, a $25 fee will be due and collected and the Rental Agreement will be deemed to be in Good Standing, or

b. If the payment is made within 1 - 5 days, a $25 fee will be due and collected and an additional $250 deposit (for each occurrence) will be due for this rental Agreement to remain in Good Standing, or

c. The Agreement will be considered Not in Good Standing, a fee will be assessed to Close the Rental Agreement and due immediately on the card used for Rental payments, and the e-bike will need to be returned or Zygg staff pickup arranged immediately - or the e-bike will be reported as stolen.

5. IF the e-bike is returned to Zygg under these conditions, the Renter will have up to 30 days from the missed payment date to Pay in Full the remaining amount due if they wish to purchase the ebike outright. Any other arrangement will be at the sole discretion of Zygg.

6. If a fee to Close the Rental Agreement is assessed, it will be based on

a. A minimum additional 3 months Rental Payment

b. $100 fee to collect the e-bike (if the ebike is not returned to Zygg)

c. Any cost for service and parts to required to make the e-bike operational and safe for new Renters

7. If the e-bike is stolen, I must complete the Term of this Agreement AND pay the final $99 - or pay the full amount immediately - on the credit card provided. That I require Canadian Photo ID with my current address (eg a drivers license), or additional deposit may be required.

8. I agree to pay for the full Term of this Rental Agreement as well as any other fees or additional deposits as per this agreement on the credit card below.

9. Any disputes of this agreement will take place in a court in Toronto, Ontario.
